4. DONATIONS AND FINANCIAL TRANSACTIONS

4.1 Donation Processing

LiftOne accepts donations through our Website via third-party payment processors, primarily Paystack, and other authorized payment methods.

By making a donation, you agree that:

  • All donations are voluntary and made of your own free will
  • Donation information you provide is accurate and current
  • You are authorized to use the payment method provided
  • You will not dispute or reverse legitimate donation transactions

4.2 Payment Processing

Payment Processor:
We use Paystack and other secure, PCI-DSS compliant payment processors to handle transactions. Your payment information is transmitted directly to these processors and is not stored on our servers.

Third-Party Terms:
Your use of payment processors is subject to their respective terms of service and privacy policies:

Transaction Fees:
Payment processors may charge transaction fees. These fees are typically deducted by the processor before funds reach LiftOne. We do not control these fees.

4.3 Donation Designations

You may designate your donation for specific purposes (e.g., “Education Lift,” “Skills Lift,” or a specific beneficiary).

We will make reasonable efforts to honor your designation. However, if the designated purpose:

  • Is fully funded
  • Becomes impractical or impossible to fulfill
  • Is no longer aligned with our mission

We reserve the right to redirect your donation to similar purposes or our general fund. We will notify you if such redirection occurs.

4.4 Recurring Donations

You may set up recurring donations (monthly, quarterly, annually) through our Website.

By establishing a recurring donation, you:

  • Authorize us to charge your payment method automatically at the selected frequency
  • Understand that recurring donations continue until you cancel
  • May cancel at any time by contacting us at liftonefoundation@gmail.com or through your donor account
  • Will receive email confirmation before each scheduled charge

Cancellation takes effect:

  • Immediately if requested before the next scheduled charge
  • After the next scheduled charge if requested after processing has begun

4.5 Donation Receipts and Tax Deductibility

Receipts:
We will provide a donation receipt via email within 48 hours of your donation for tax and record-keeping purposes.

Tax Deductibility:
LiftOne Humanitarian Foundation is registered with the Corporate Affairs Commission (CAC) in Nigeria. Donations may be tax-deductible under Nigerian tax law and certain international jurisdictions.

Important: We are not tax advisors. Please consult your tax professional regarding the deductibility of your donation in your specific jurisdiction.

International Donors:
We are working to establish tax-deductible status in additional countries (U.S. 501(c)(3) fiscal sponsorship, UK Gift Aid eligibility, etc.). Contact us for current status.

4.6 Refund and Cancellation Policy

Donation Refunds:
All donations are generally non-refundable once processed, as they are immediately allocated to our programs and beneficiaries.

Exceptions:
We will issue refunds in the following circumstances:

  • Duplicate charges due to technical error
  • Unauthorized transactions (you must report within 30 days)
  • Designated donations for programs that cannot be fulfilled (we will redirect to similar purposes unless you request a refund)

Refund Requests:

  • Donation date and amount
  • Transaction reference number
  • Reason for refund request

Processing Time:
Approved refunds will be processed within 14 business days to your original payment method.

4.7 Currency and Exchange Rates

We accept donations in multiple currencies (Nigerian Naira, USD, GBP, EUR, CAD).

Exchange Rate Conversions:
For international donations, exchange rates are determined by our payment processor at the time of transaction. We do not control exchange rates or conversion fees charged by payment processors or banks.

Displayed Amounts:
Currency conversions displayed on our Website are approximate and for informational purposes only. Actual amounts charged may vary slightly due to exchange rate fluctuations.


5. INTELLECTUAL PROPERTY RIGHTS

5.1 LiftOne’s Intellectual Property

All content, features, functionality, and materials on the Website, including but not limited to:

  • Text, graphics, logos, images, videos, audio
  • Software, code, databases, and technology
  • Trademarks, service marks, trade names, and branding
  • Design, layout, look and feel of the Website

are owned by or licensed to LiftOne Humanitarian Foundation and are protected by Nigerian and international intellectual property laws, including copyright, trademark, patent, trade secret, and other proprietary rights laws.

“LiftOne Humanitarian Foundation,” “LiftOne,” “Lifting Lives. Building Futures,” and associated logos are trademarks of LiftOne Humanitarian Foundation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFTONE’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES SHALL NOT EXCEED THE GREATER OF:

  • Specific outcomes or results from our programs
  • That beneficiaries will achieve certain milestones
  • That donations will be used exactly as designated in all circumstances (though we make reasonable efforts)
  • That our programs will continue in perpetuity

Humanitarian work involves inherent uncertainties, challenges, and external factors beyond our control.

7.5 Donor Acknowledgment

By making a donation, you acknowledge and agree that:

  • Donations are voluntary contributions to support our mission
  • You are not purchasing goods or services
  • Donations are generally non-refundable (except as outlined in Section 4.6)
  • LiftOne exercises discretion in program implementation and fund allocation
  • Impact stories and outcomes are illustrative but not guaranteed for all beneficiaries

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LiftOne Humanitarian Foundation and its officers, directors, employees, volunteers, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees) arising from or related to:

  • Your use or misuse of the Website or services
  • Your violation of these Terms
  • Your violation of any rights of third parties, including intellectual property rights, privacy rights, or publicity rights
  • Your User Content or any content you submit, post, or transmit
  • Your conduct in connection with the Website or services

Step 1: Informal Resolution (Required First Step)

Mediation costs shall be shared equally between the parties.

Step 3: Arbitration or Litigation (Last Resort)

If mediation fails or either party declines mediation, Disputes may be resolved through:

Option A: Arbitration

  • Conducted under the rules of the Nigerian Arbitration and Conciliation Act
  • Single arbitrator mutually agreed upon by the parties
  • Location: Abakaliki, Ebonyi State, Nigeria (or virtual)
  • Arbitration costs shared equally; each party bears its own legal fees

Option B: Litigation

  • Jurisdiction: Courts of Ebonyi State, Nigeria
  • You consent to personal jurisdiction and venue in these courts
  • Each party bears its own legal costs unless awarded by the court

9.3 Class Action Waiver

YOU AND LIFTONE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both you and LiftOne agree otherwise in writing, the arbitrator or court may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.

9.4 Time Limitation on Claims

You agree that any claim or cause of action arising from or related to these Terms or the Website must be filed within one (1) year after the claim or cause of action arose, or it shall be permanently barred.


10. GENERAL PROVISIONS

10.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any Additional Terms incorporated by reference, constitute the entire agreement between you and LiftOne Humanitarian Foundation regarding your use of the Website and services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.

10.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable.   • A successor entity in connection with a merger, acquisition, or sale of assets

10.5 Force Majeure

LiftOne shall not be liable for any failure or delay in performing obligations under these Terms due to causes beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, fires, natural disasters)
  • War, terrorism, civil unrest, or government action
  • Pandemics, epidemics, or public health emergencies
  • Internet or telecommunications failures
  • Power outages or infrastructure failures

10.6 Relationship of Parties

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and LiftOne. You have no authority to bind LiftOne or make commitments on our behalf.

By volunteering with LiftOne, you additionally agree to:

  • Undergo any required background checks or screenings
  • Maintain confidentiality of beneficiary information
  • Not use beneficiary stories or information for personal purposes
  • Sign a separate Volunteer Agreement (if required)

11.3 For Beneficiaries

Program participation is subject to:

  • Eligibility criteria for specific programs
  • Ongoing compliance with program requirements

13. ACKNOWLEDGMENT AND ACCEPTANCE
